It is the responsibility of the user to read and accept the Travel Away Inc. Terms and Conditions before purchasing Travel services.
It is also the responsibility of the user to read the rules and regulations of the tour company or Airline in which you are purchasing travel services, these rules and regulations can be found on their web sites or on the back of their brochures. This should be done during the booking process.

Adventures A.W.A.Y.Com is an information site only and all travel is handled by Travel Away Inc. These Terms and Conditions are applicable to all users of the website. By using this website you agree solely, without modification, to the terms and conditions listed below and to the terms and conditions of the respective tour company in which you are booking your travel services.

Users of the website shall be referred to as 'the customer' in these Terms & Conditions.

RESPONSIBILITY
Travel Away Inc., is a licensed travel agency in the province of Ontario; as such it offers the service of providing travel information and reservations, as provided by various third party suppliers, to the customer.

Customers must be at least 18 years of age in order to purchase travel services from Travel Away Inc. Customers must agree to all of the terms and conditions listed on this page.

Pricing and Content
All prices within this website are in Canadian dollars unless otherwise stated. Airport fees and taxes, where applicable, are not included in the pricing. All prices on this website are subject to change without prior notice. Any changes in pricing that may occur before, during or after a purchase, as a result of a tour operator change, are not the responsibility of Travel Away Inc. Once a booking is complete, pricing CANNOT be adjusted. Pricing and availability on all packages and flights is not guaranteed until confirmed.

All products are subject to availability. All content, such as hotel and destination information, on this website is provided only as a guideline and may not be an exact representation. Travel Away Inc. is aware that the customer is in demand of accurate information and as a result makes every effort possible to ensure that the content within this website is up-to-date. However, due to constant changes and occasional circumstances beyond our control some of the hotel and destination information within this website may not be 100% accurate.

Travel Away Inc will endeavor to ensure that images on this website are as close a representation as possible but cannot be held responsible for changes beyond our control. Hotel and destination images on this website are representation only and cannot be guaranteed completely accurate.

Hotel ratings within this website are the opinion of the Tour Operators.. While Travel Away Inc. will make every attempt to provide the lowest pricing, occasionally circumstances beyond our control may prevent us from providing the lowest price. These circumstances may include but are not limited to group pricing, blocked space pricing, at source discounts, and exclusive price agreements. Prices are only guaranteed at time of booking and will not be lowered once the booking is complete. Price changes made by the airline or tour operator after a booking has been completed cannot be matched.

PAYMENT
Payment for bookings is required in full at the time of purchase. Your purchases can be made by using Visa, MasterCard, or American Express credit cards. Some Airlines and Tour Operators charge a User Fee. Airfare and vacation package purchases are 100% non-refundable. Third party credit cards bookings will only be processed after receiving written confirmation from the card holder. You will be required to fax us a copy of the back and front of 3rd party cardholders' credit card, (make it as light as possible so that it is legible) along with a copy of the cardholder's driver's license, along with their address so we can verify address to credit card. The 3rd party cardholder will also need to write on the fax that he/she accepts responsibility for payment of the charges (put amount) and a signature will be required. All fraudulent purchase will be investigated and prosecuted.

CONFIRMATION AND DELIVERY
After a purchase is made, the customer will receive an email confirming their purchase. It is the responsibility of the customer to verify that the information on the confirmation email is in accordance with the travel product that they have purchased. If there is a discrepancy between the information on the e-mail and that of what the customer booked, the customer MUST contact our office at the following (416-626-2929 or 1-866-793-2403 ) within 24 hours from the time of booking.

The customer may decide to have their tickets delivered to them via courier or receive them via airport pick-up. Courier deliveries are applicable to an additional fee of $15.00 within Ontario and $25.00 for the rest of Canada. If the customer chooses the airport pick-up option the tour operator will deliver the customer's tickets to the airport and the customer may pick them up on the day of departure. The customer is responsible to comply with the applicable tour operator's airport pick-up conditions.

Toronto area customers may also choose to pick-up their tickets at the Travel Away Inc. office.

Travel Away Inc. receives documents from the tour operator usually 2-3 weeks before departure. Once they are received by us, they will be processed and then sent to the customer via courier. The tickets will be delivered to the customer at least 1 week prior to departure. For last minute purchases (departures within 3 weeks) tickets are available on an airport pick-up option only.

DOCUMENTATION
It is the responsibility of the customer to obtain all the necessary documents, such as valid passports and visas, required to gain entry into the country of destination. Obtaining passports and visas may require lengthy processing times; it is the responsibility of the customer to ensure that all required documentation is received before travel departure.

IMPORTANT - Children 18 and under traveling alone or with only one parent MUST have a notarized letter of authorization signed by the parent who is not traveling or if both parents are not traveling with the child, this note must be signed by both parents.

Cancellation
Airfare and vacation package purchases are 100% non-refundable. Some purchases MAY be changeable for a fee that is determined by the tour operator that you have made your reservation with, this is at the discretion of each individual Tour Operator or Airline It is highly recommended that the customer purchase travel insurance in order to protect themselves against the loss of their purchase due to unforeseen circumstances. Please see below.

Insurance
For every sale, Travel Away Inc. offers the option to purchase R.B.C. Travel Insurance to cover the customer against any unforeseen circumstances that may occur prior to, during or after your trip. There are different types of insurance packages available and the purchase of insurance is an optional decision to the customer. Travel Away Inc. highly recommends purchasing travel insurance. If the customer wants to make an insurance claim, it is their responsibility to contact Travel Away Inc. as soon as possible. Please contact us if you require more information regarding travel insurance.

Ownership
None of the content found on this website may be reproduced, republished, displayed, distributed, modified, sold, or transferred without the written consent of Travel Away Inc. This website is to be used to gather information on travel-related goods and service and to make legitimate purchases and/or reservations. This website may not be used to make any false, fraudulent, or speculative purchases and/or reservations.

Jurisdiction and Legality
The Adventures A.W.A.Y website is operated by Travel Away Inc. office in Toronto, Ontario. All purchases on the website are processed according to Ontario regulations.

Travel Away Inc. does not divulge customer information to third parties; however, we may do so if required by government or law enforcement authorities, court order.

Third Party Suppliers
All travel packages, airfares and hotels displayed on this website are supplied to Travel Away Inc. by various third party suppliers (tour operators, and Airlines ) and in turn are subject to their own Terms & Conditions. Travel Away Inc. is merely a seller for the third party suppliers and is in no way responsible for incidents brought upon or caused by any of the third party suppliers.

When the customer purchases travel services through Travel Away Inc .they must refer to the appropriate third party suppliers Terms & Conditions.

Travel Away Inc. cannot be held liable for any loss, damage or injury of any nature whatsoever whether to person or property that may arise from the purchase of any travel services through this Agency. By purchasing travel services, the customer, hereby understand and agree without modification to the terms and conditions listed above.
